<p><strong>(Seattle, WA) June 27, 2012 </strong>– Gallivan, Gallivan and O’Melia (GGO, LLC), announced today that the company will sponsor an “Aerobathon” event on June 30th at the Sammamish Club in Issaquah Washington.  The event invites fitness enthusiasts to participate in a 5-hour series of workout sessions.  Participants are collecting support pledges from family and friends, and all proceeds will go to support Art with Heart, a Seattle area non-profit organization offers supportive workshops and training sessions to help high-risk youth overcome trauma through creative self-expression.</p>
<p>&#8220;Art with Heart is so excited about the Aerobathon at the Sammamish Club this Saturday.  We are very thankful to all the sponsors like GGO!” said Gabe Meyer, Director of Fundraising &amp; Events.  “Because of their help, we are able to help more at-risk kids and teens in crisis through art and creativity.&#8221;</p>
<p>Sammamish Club trainer John McKinnon came up with the Aerobathon idea to provide members of the community with an opportunity to get in great shape, contribute funds to help kids in need, and (coincidentally) celebrate his 50th birthday.  The event team is well on its way to achieving the fund-raising goal of $10,000.</p>
<p>The event is open to Sammamish Club members from 7-9am, and is open for non-members and drop-ins from 9:00 to noon.  All activities will take place at the Issaquah Sammamish Club on Northwest Poplar Way in Issaquah.  Event Line-up:<br />

The Court also noted that the Safe Harbor provisions of Rule 37(e) do not apply if data destruction is not suspended after a litigation hold. •Omnicare, Inc. v. Mariner Health Care Mgmt. Co. 2009 WL 1515609 The court ruled in this case that just because “ESI is now contained on backup tapes instead of in active stores does not necessarily render it not reasonably accessible.”</p>

<p>Ryan v. Gifford Civ. No. 2213-CC, 2007 WL 4259557 (Del. Ch., Nov. 30, 2007) The Court ordered “the production of documents identified in plaintiffs’…motion to compel in a format that will permit review of metadata, as plaintiffs have clearly shown a particularized need for the native format of electronic documents with original metadata.”</p>

			<content:encoded><![CDATA[<p>Bill Gallivan to Speak at the Silicon Valley Intellectual Property Law Association (SVIPLA) Presentation &#8211; &#8220;E-Discovery and IP Litigation&#8221; on November 17, 2010. Recent case law will be explored regarding risks arising out of obligations and responsibilities relating to e-discovery in IP litigation. The evolving definition of negligence, gross negligence and willful misconduct will be addressed in the context of collection, identification or preservation of documents in anticipation of litigation or after a legal hold has been issued. In particular, recent case law will be discussed with a view toward delineating practical steps to reduce exposure, including outlining specific strategies that practitioners may use as a basis for advising their clients and analyzing cost to risk ratio of adopting these practices.</p>
